1. Introduction and Acceptance of Terms
Welcome to Les Femmes ("we," "our," "us"). These Terms and Conditions ("Terms") govern your use of our website (lesfemmes.ae) and mobile application (collectively, the "Platform"). Les Femmes operates as a premium designer resale marketplace and e-commerce boutique, allowing users to buy and sell authenticated luxury fashion.
By accessing, browsing, or using our Platform to purchase or sell items, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.
2. Eligibility and Account Registration
- Age Requirement: You must be at least 18 years old to create an account and use our services.
- Account Accuracy: When registering, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Account Types: We offer standard user accounts (for buying and private selling) and registered Business Seller accounts.
3. Buying on Les Femmes
- Product Descriptions: We strive to ensure that all items listed (whether retail or pre-loved) are described accurately, noting any minor flaws for pre-owned items. However, we do not warrant that descriptions or other content are entirely error-free.
- Order Acceptance: All orders are subject to acceptance and availability. Once you place an order, you will receive an acknowledgment email. This does not confirm acceptance. The contract between you and Les Femmes is formed only when the item is dispatched.
- Pricing: Prices are shown in AED (United Arab Emirates Dirham) or your selected local currency. We reserve the right to correct pricing errors. If an item is mispriced, we may cancel the order and issue a full refund.
4. Selling on Les Femmes
As a marketplace, Les Femmes allows users to sell pre-loved luxury items.
- Listing: Sellers must provide accurate descriptions and images of items.
- Commissions & Payouts: For items sold through our Platform, Les Femmes retains a commission fee. Standard private sellers earn a standard percentage (e.g., 80%) of the sale price, while registered resale businesses may be eligible to earn a higher tier (e.g., 90%).
- Fulfillment: Sellers must hand over the sold items to our designated courier partners in a timely manner.
5. Authentication and Quality Control
Trust is paramount at Les Femmes.
- Every item sold through our resale platform is subject to a rigorous authentication and quality control process.
- If an item submitted by a seller is found to be counterfeit or significantly not as described, the sale will be canceled. The buyer will be refunded, and the seller may face penalties, return shipping fees, or permanent suspension from the Platform.
6. Payments, Taxes, and Duties
- Payment Methods: We accept major credit/debit cards and other secure local and international payment gateways.
- Taxes: All applicable local taxes, including UAE Value Added Tax (VAT), are calculated at checkout.
- Customs & Import Duties: For international orders shipped outside the UAE, the buyer is responsible for any import duties, customs fees, and local taxes levied by the destination country.
7. Shipping and Delivery
- Global Shipping: We ship locally within the UAE and internationally. Estimated delivery times are provided at checkout and are indicative only.
- Delays: Les Femmes is not liable for delivery delays caused by customs clearance, courier delays, or unforeseen circumstances beyond our control.
8. Returns and Refunds
- Retail Items: Brand new retail items may be returned within [Insert Number] days of receipt, provided they are unworn, with all original tags attached and in original packaging.
- Pre-Loved/Resale Items: Due to the nature of the resale marketplace, pre-loved items are generally considered Final Sale unless the item received is definitively proven to be inauthentic or drastically different from its listing description.
- Refund Processing: Approved refunds will be credited back to the original method of payment within 7–14 business days.
9. Intellectual Property
All content on the Les Femmes Platform, including but not limited to logos, text, graphics, images, software, and the compilation thereof, is the exclusive property of Les Femmes or its content suppliers and is protected by local and international copyright and trademark laws. You may not use, reproduce, or distribute any content without our express written permission.
10. Prohibited Conduct
You agree not to:
- Use the Platform for any illegal or fraudulent purpose.
- Sell counterfeit goods, stolen items, or items infringing on third-party intellectual property rights.
- Attempt to bypass our payment systems or take transactions offline.
- Interfere with the security or functionality of the Platform.
11. Limitation of Liability
To the maximum extent permitted by law, Les Femmes, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, the purchase of products, or these Terms.
12. Governing Law and Jurisdiction
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the federal laws of the United Arab Emirates (UAE) and the local laws applicable in the Emirate of Dubai. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai.
13. Changes to Terms
We reserve the right to update, modify, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of the Platform following the posting of any changes constitutes acceptance of those changes.
